Terms of service
In effect from 18 August 2026.
1. Parties
These terms form the agreement between Fractionals Match (“fractionalsmatch”, “we”, “us”) and the person who creates an account (“you”, “your”). They take effect when you create an account and apply for as long as you hold one.
fractionalsmatch is supplied for business use. By accepting these terms you confirm you are acting for purposes relating to your trade, business or profession — as a founder or leader hiring for a company, or as a fractional operator offering your work.
2. Definitions
- Service — the fractionalsmatch application at fractionalsmatch.com, its interfaces and any feature we make available under these terms.
- Your Content — the assessment answers, capability records, evidence, briefs, messages and other material you put into the Service.
- Operating Profile — the scores, archetypes and derived signals the Service builds from your assessment answers.
- Match — an indicative, ranked suggestion that two people may work well together. A Match is information, not an offer, a contract, or a guarantee.
- Introduction — a request one user sends another through the Service to start a conversation.
3. What the Service is, and what it is not
fractionalsmatch measures how people operate — through a behavioural diagnostic and a capability record weighted by evidence — and ranks likely fit between companies and fractional operators on the problem to be solved. It is a matching intelligence tool.
It is not a recruitment agency, an employer, a party to any engagement, or professional advice. Any engagement you enter with a person you met through the Service is between you and them: its terms, its performance, its payment and its compliance (including employment status and tax treatment, such as IR35 in the UK) are entirely your responsibility.
We do not verify the claims users make. The engine weights evidence above claims, but evidence is user-supplied and is not certified by us. Judge it as you would any professional reference.
While the network grows, some profiles shown in matching are labelled sample profiles, built from anonymised market data to demonstrate how matching works. An introduction to a sample profile does not reach a real person.
4. Licence
We grant you a non-exclusive, non-transferable, revocable licence to use the Service for your own business for as long as this agreement lasts. You acquire no ownership in the Service. You may not copy, resell, sub-licence, reverse-engineer or rebrand it, or use it to build a competing product.
Keep your account credentials secure; you are responsible for what is done under your account. Tell us promptly if you believe your account has been compromised.
5. Acceptable use
You must not use the Service to:
- submit false or misleading claims or evidence — the Service exists to rank on what is real, and gaming it harms every other user;
- submit another person’s personal data without the right to do so;
- scrape, harvest or systematically extract other users’ profiles or contact details, or use the Service to send unsolicited messages;
- store special category personal data, payment card numbers, or material subject to sector-specific regulation the Service is not built for;
- break the law or infringe another party’s rights;
- probe, load-test or interfere with the Service or its infrastructure, or attempt to reach data that is not yours;
- share one account between people who should hold their own.
6. Your content and your profile
Your Content remains yours. You grant us only the licence needed to run the Service: to store, process and display Your Content — and the Operating Profile derived from it — to you and, where matching is the point, to the users you may be matched with. Showing your profile to potential matches is what the Service is for; if you do not want that, do not create a profile.
We do not use Your Content to train artificial intelligence models, and our sub-processors are engaged on terms that do not permit them to either.
Feedback you give on matches (including telling us a match was wrong) may be retained and used to improve the matching engine.
7. A free service, for now
The Service is currently provided without charge. It is provided as-is and may be changed or withdrawn on reasonable notice. If we introduce paid plans, we will give you at least 30 days’ notice and nothing you already have will be taken away without it.
8. Availability and support
We aim to keep the Service available at all times, and we do not offer a contractual uptime guarantee or service credits. Support is provided by email at hello@fractionalsmatch.com during UK business hours.
9. Warranties
We warrant that we will provide the Service with reasonable skill and care, and that we have the right to grant the licence in section 4.
Beyond that, and to the extent the law permits, the Service is provided without further warranties, express or implied. In particular: we do not warrant that a Match is accurate or complete, that matching will lead to any engagement, or that AI-generated narrative about a profile is free of error — it is an interpretation for you to weigh, not a fact for you to rely on.
10. Liability
Neither party limits its liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that:
- neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings;
- we are not liable for the conduct of any user you engage with, or for the outcome of any engagement entered following a Match;
- our total liability arising out of this agreement is limited to £100, reflecting that the Service is provided without charge.
11. Indemnity
You will indemnify us against claims and losses arising from Your Content, from your use of the Service in breach of these terms, and from any engagement you enter with another user.
12. Intellectual property
The Service, its software, its matching engine, design and documentation belong to us and to our licensors. Your Content belongs to you. Feedback you send us may be used to improve the Service without obligation, and gives us no rights over Your Content.
13. Confidentiality
Each party will keep the other’s confidential information in confidence and use it only to perform this agreement. This does not apply to information that is public through no breach, was already held without a duty of confidence, or must be disclosed by law — and where the law allows, we will tell you before disclosing.
14. Data protection
We process personal data as controller, as described in the privacy policy. Where you submit personal data about others (for example, naming a referee in evidence), you are responsible for having the right to do so.
15. Suspension and termination
You may stop using the Service at any time, and may ask us to close your account and delete your data as described in the privacy policy. We may suspend or terminate access if you materially breach these terms, if your use puts the Service or other users at risk, or if we are required to by law — and we will tell you why unless the law prevents us.
We may discontinue the Service on 30 days’ notice. Sections 6, 9, 10, 11, 12 and 13 survive termination.
16. Force majeure
Neither party is liable for a failure to perform caused by an event beyond its reasonable control, for as long as that event continues.
17. General
We may update these terms. Material changes are notified by email or in the Service at least 30 days in advance; continuing to use the Service after they take effect means you accept them. You may not transfer this agreement without our consent; we may transfer it to a successor of our business, on notice to you. If a provision is unenforceable, the rest continues in force. A delay in enforcing a right is not a waiver of it. These terms, with the documents they refer to, are the entire agreement between us.
18. Governing law
This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Before starting proceedings, each party will raise the dispute in writing and allow 30 days to resolve it.
